The Court of Appeal has granted the Labour Party’s Presidential candidate in the February 25th, 2023 presidential election, Mr Peter Obi’s request to serve Tinubu his petition challenging the result of the election that produced Tinubu as the president-elect.

Mr Obi is challenging the victory of senator Bola Ahmed Tinubu of the All Progressives Congress, APC, in the recently concluded presidential election.

Peter Obi had, on Tuesday, March 21 filed his petitions to the presidential elections tribunal challenging Tinubu’s victory at the polls.

Obi jointly filed the petition with his party, Labour Party and has INEC, Tinubu, Shettima Kashim, and the All Progressives Congress (APC) as the respondents.

Here are 5 of his prayers challenging Tinubu’s victory:

1. Eligibility:

The LP presidential candidate is praying the court to nullify Tinubu’s victory at the polls on grounds that Tinubu was not eligible to contest the election.

According to Obi’s lawyer, Livy Uzoukwu, Tinubu “was not duly elected by majority of the lawful votes cast at the time of the election.”

He said the president-elect should not have been cleared in the first place to contest the election because he is not eligible.

 

2. 25 % in FCT:

 

Peter Obi is also praying the court to nullify Tinubu’s victory on the grounds that the APC candidate did not win 25% votes in the FCT as stipulated by the constitution.

The clauses, 25% in the FCT And 24 States’ Requirements for winning presidential and governorship elections in Nigeria as well as if the FCT further arises again.

Obi said “that the 2nd Respondent (Tinubu) having failed to score one-quarter of the votes cast at the Presidential Election in the Federal Capital Territory, Abuja, was not entitled to be declared and returned as the winner of the presidential election held on 25 February 2023.”

3. Election Cancellation:

 

Also, Mr Peter Obi is praying the court to cancel the February 15th presidential elections over violence in many polling units.

In an earlier statement by the Labour Party Chairman, Julius Abure, he called for the cancellation of the election.

He said as thus: “We took particular note of incidences in places like Obio/Akpor, Khana, Eleme, Obigbo, Rumukoro and several other areas where Labour Party was clearly leading in virtually all the polling units with very wide margins.

“Nigerians went into this election based on the assurances by INEC that the deployment of BVAS was a perfect antidote to electoral malpractices in Nigeria.

“But what transpired across Nigeria, if allowed to stand is purely a betrayal of trust of millions of Nigerians by INEC.”

 

4.Conduct Fresh Elections Without Tinubu Participating:

 

Obi is equally asking the court to order INEC to conduct fresh polls and that Tinubu should not be among the candidates.

He said, according to him, that since Tinubu is not eligible to contest the election a fresh election without Tinubu would be a welcome development.

 

5. He can verify Thugs manipulated BVAS and uploaded fake results:

 

According to Obi’s Labour Party Chairman, thugs intimidated INEC officials.

Also,  military personnel and police officers equally intimidated them. .

He said, “Nigerians went into this election based on the assurances by INEC that the deployment of BVAS was a perfect antidote to electoral malpractices in Nigeria.

“But what transpired across Nigeria, if allowed to stand is purely a betrayal of trust of millions of Nigerians by INEC.”

Consequently, Obi is banking on these prayers to ask the court to nullify Tinubu’s victory.
